Effective immediately, please DISCONTINUE the use of the 2005 version of the KCRAR Agency Disclosure Form. The 2005 form provides that the compensation is determined in the agency agreements, however, Missouri Real Estate Commission feels that the Missouri license law in 4 CSR 250-8.096 requires that the compensation be specifically identified in the Agency Disclosure Form. In compliance with MREC's requirement, KCRAR has revised the Agency Disclosure Form for immediate use by the members.
You can obtain the new form from the KCRAR website at http://kcrar.harbecksoftware.com/pdf/2006AgencyDisclosureAddendumNewApproved.pdf
On the 2006 form we have added two boxes on Lines 46 & 47 to allow for identifying specifically who is paying compensation to the brokers.
- If the seller is the SOLE source of compensation
in the transaction, check the box marked “Seller”.
- If the buyer is the SOLE source of compensation
in the transaction, check the box marked “Buyer”.
If both buyer and seller are paying any type of compensation in the transaction, check BOTH boxes. An example of both parties paying would be the Seller paying part of the commission or a transaction fee or other type of fee charged by the brokerage and the buyer paying part of the commission or a transaction fee or other type of fee charged by the brokerage.
DO NOT USE THE 2005 KCRAR AGENCY DISCLOSURE ADDENDUM
