Due to new legislation in Kansas effective July 2008, specific language regarding "sexual offenders" is required on every contract for the sale of residential real estate. A Missouri House Bill effective in August 2007 states a real estate brokerage firm or its affiliated licensees shall be immune from liability for any act or omission related to the disclosure of information regarding individuals required to register under section 589.400 if the brokerage firm or its affiliated licensees provide to its clients or customers in a timely manner a written notice that they may obtain information about the sex offender registry and persons registered with the registry by contacting the county sheriff or the Missouri highway patrol.
New text was inserted into the 2008 KCRAR Residential Real Estate Sale Contract and the Buyer Agency Agreements to comply with both KS & MO House Bills. If you are using the KCRAR New Home Sale Contract or the KCRAR Vacant Land Sale Contract for a residential transaction, you will also need to use the newly released form, "Addendum to New Home Residential/Vacant Land Sale Contract". This addendum contains the same "sexual offender" text that has been added to the Residential Sale Contract form. In 2009, this text will be included in the New Home and Vacant Land Sale Contracts and the Addendum will be eliminated.
